European Union: Authorization for the use of maltitol is harmonized in the 25 member states of the European Union:

As a sweetener - Directive 94/35/EC (OJ No L237, 10.9.94)
As an addditive with a technological function other than sweetening - Directive 95/2/EC (OJ No L61, 18.3.95) Maltitol should be listed in the ingredient list with its technological function as "maltitol" or by its European Code number E965. In the European Union, the energy value for maltitol has been agreed as 2.4 kcal/g - Directive 90/496/EEC (OJ No L276, 6.10.90).

North America
USA: The submission of GRAS petition file (GRAS 6G0319) was accepted by the FDA in 1986 (Fed. Reg. 23/12/86). In 1999, the FDA published a "non-objection" letter to the use of a caloric value of 2.1 kcal/g. Canada: Authorized in Canada.
